Key jury questions proposed by Sam Bankman-Fried should be thrown out because they are ”repetitive, prejudicial, and argumentative,” the U.S. Department of Justice (DOJ) said.
Both Bankman-Fried and the defence presented their voir dire questions to the court last week. They are meant to assist in selecting a jury that is impartial and fair.
The prosecution says Bankman-Fried’s questions are “unnecessarily intrusive” and “time-consuming,” and objected to questions in four of the 14 sections of the questions proposed. These are questions concerning pretrial publicity, the effective altruism philosophical movement, political donations and lobbying, and attention-deficit hyperactivity disorder (ADHD).
Questions such as “If you were a juror on this case, would you agree that Samuel Bankman-Fried would be starting off a little bit behind or that the Government might have a little head start?” are unjustifiable, said the prosecution because the defendant has played an active hand in fomenting press coverage about himself and the case, both before and after his arrest.
Questions about effective altruism were termed as a “thinly veiled attempt to advance a defense narrative that the defendant was simply “amassing wealth” in order to “improve the world.”

It was also unhappy with some questions that referenced ADHD because in support of Bankman-Fried’s diagnosis the defence had only produced a letter from a psychiatrist who formerly worked as “FTX’s in-house coach,” it said. Given that witnesses had described the coach as liberally dispensing prescriptions to FTX employees, including for Adderall, it is not enough to substantiate that Bankman-Fried suffers from ADHD, they said.

Bankman-Fried’s Trial Approaches
Bankman-Fried’s lawyers have criticized the government’s actions leading up to the anticipated criminal trial, which is set for early October.

On August 28, the prosecution turned over more than four million pages of evidence which the defense claimed was too large to review prior to any trial.
The government was accused by SBF’s attorneys of failing to provide him with sufficient internet connectivity at the Metropolitan Detention Center in Manhattan after the government ordered his incarceration on August 11.

Bankman-Fried has asked the court for leniency to help with trial preparations. However, Judge Kaplan decided on September 13 to reject SBF’s request for a temporary release from prison in order to better prepare for his impending fraud trial. The judge stated that SBF was not entitled to see all the evidence against him.
