Sam Bankman-Fried Has Sufficient Access to Laptop, Internet To Prepare His Defence, Prosecution Says

DOJ Confirms Sam Bankman-Fried's Sufficient Access to Legal Tools Amid Detention  Sam Bankman-Fried, the founder of the now-closed crypto exchange FTX, has secured better access to crucial legal resources while detained at the Metropolitan Detention Center (MDC) in Brooklyn, the US Department of Justice (DOJ) said. Since August 31, 2023, Bankman-Fried has been able to use an “air-gapped laptop” for reviewing electronic discovery materials. The laptop is available for a substantial 11 hours on weekdays (from 8:00 a.m. to 7:00 p.m.) and 7.5 hours on weekends and holidays (from 8:00 a.m. to 3:30 p.m.), the DOJ reported. The DOJ emphasized that defense counsel doesn't need to be present during these sessions, simplifying the process. "To date, there have been no reported issues with the functionality of the USB ports and software applications utilized thus far," the letter read.  Bankman-Fried's access to key hard drives has also been streamlined. Two hard drives were initially shipped to him in late August, with a third hand-delivered by his defense team on September 1, 2023. These hard drives are vital for his legal defense and preparation, the DOJ added.  In a collaborative effort to prevent any delays, the MDC has agreed to accept hard drives directly from Bankman-Fried's defense counsel. These drives are promptly processed and provided to the defendant.  Currently, he has three of these etched hard drives in his possession. "Separate from the Etched Hard Drives, defense counsel can bring their own hard drives ('Counsel Hard Drives') to their legal visits,” the letter clarified. “This allows them to upload and download materials without MDC staff involvement." Internet-enabled Laptop Bankman-Fried has also retained access to an internet-enabled laptop for at least two days each week. Recent tests conducted by the Government showed varyin​​g internet speeds throughout the day. During mornings and early afternoons, the download speed reached 34 Mbps, while it slowed to 7.5 Mbps in the late afternoon,  the US Prosecutors reported.  However, the DOJ argued that these internet speeds should be “sufficient for most internet review activities”.  Bankman-Fried's internet-enabled laptop has a new 9-cell battery provided by his defense counsel. This battery has approximately 8 hours of battery life, the DOJ reported. Judge Denies Bankman-Fried's Release Request Bankman-Fried faced the revocation of his bail back in August, for tampering with witnesses. His legal team had requested a temporary release from jail, seeking to collaborate on his defense at the federal courthouse in Manhattan. Their argument centered around the challenges posed by poor internet connectivity and limited battery life, which they believed were significant obstacles to effective defense preparation.  However, Judge Lewis Kaplan declined the request during a hearing that took place last week. Judge Kaplan instructed all parties involved to compile a comprehensive report on the matter. Bankman-Fried is approaching his trial scheduled for October 3, 2023. Sam Bankman-Fried, the founder of bankrupt crypto exchange FTX, has sufficient laptop and internet access to prepare for his defence against fraud charges, prosecutors said.

Bankman-Fried has access to a laptop for 11 hours each weekday and 7.5 hours on weekends, and it’s been fitted with a new 9-cell battery provided by his defense counsel, the Department of Justice said in a letter submitted to the court on Sept. 5.  The battery has approximately 8 hours of battery life, it added.

Bankman-Fried’s access to hard drives has also been improved. Two hard drives were initially shipped to him in late August, with a third hand-delivered by his defense team on September 1, it said. 

Sam Bankman-Fried’s Release Request Denied

After Bankman-Fried had his bail revoked in August for tampering with witnesses, his legal team has argued that his ability to prepare for trial is hampered by poor internet connectivity and limited battery life for his laptop. His lawyers had requested a temporary release from jail, seeking to collaborate on his defense at the federal courthouse in Manhattan. 

Judge Lewis Kaplan declined the request during a hearing last week, and instructed all parties involved to compile a comprehensive report on the matter.

Bankman-Fried’s trial is scheduled to begin on October 3.
