Shelby wrote in a court <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.utd.141167\/gov.uscourts.utd.141167.215.0.pdf\">filing<\/a> on Nov. 30 that he was &ldquo;concerned the Commission made materially false and misleading representations&rdquo; in arguing for a technical restraining order (TRO) against DEBT Box.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">&#128064;SEC Sanctions&#128064;<br>11\/30\/2023 &ldquo;Court orders SEC to show cause why it should not be sanctioned for making false and misleading representations to the Court. SEC v Debt Box&rdquo; <a href=\"https:\/\/t.co\/F1c0QloC0E\">pic.twitter.com\/F1c0QloC0E<\/a><\/p>\n<p>&mdash; Cowboy.Crypto (@cowboycrypto313) <a href=\"https:\/\/twitter.com\/cowboycrypto313\/status\/1730679152225747439?ref_src=twsrc%5Etfw\">December 1, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400\">One of the <\/span><a href=\"https:\/\/insidebitcoins.com\/news\/xrp-price-prediction-xrp-jumps-on-possible-ripple-sec-settlement-talks-as-investors-rush-to-buy-this-bitcoin-mining-platform-before-time-runs-out\"><span style=\"font-weight: 400\">SEC&rsquo;s<\/span><\/a><span style=\"font-weight: 400\"> claims was that DEBT Box was actively in the process of moving assets overseas. The agency alleged the firm closed its bank accounts in June 2023 to &ldquo;move investor funds&rdquo; to the United Arab Emirates in what appeared to be an attempt to evade federal securities laws.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In&nbsp; a July <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.utd.141167\/gov.uscourts.utd.141167.214.0.pdf\">filing<\/a>, it also said that DEBT Box had closed 33 bank accounts in the previous 48 hours. This was supposedly &ldquo;the most significant evidence&rdquo; that DEBT Box was attempting to move funds overseas. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The SEC also stated that the defendants were blocking investigators from viewing social media pages. Given the claims, judge Shelby decided to approve the TRO.<\/span><\/p>\n<p>But i<span style=\"font-weight: 400\">n a motion to dissolve the TRO in September, the <\/span><a href=\"https:\/\/cointelegraph.com\/news\/sec-freeze-assets-debt-box-alleging-fraud\"><span style=\"font-weight: 400\">defendants<\/span><\/a><span style=\"font-weight: 400\"> argued that zero bank accounts were closed in June or July of this year. They said they had closed thirteen of the bank accounts in question on or before January 2023. Another nine accounts were also closed by banks, not the defendants. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Following this argument, Shelby wrote that there was &ldquo;no evidence that any bank accounts closed in the 48 hours preceding the ex parte hearing.&rdquo;&nbsp;<\/span><\/p>\n<h2>The SEC May Be Fined<\/h2>\n<p><span style=\"font-weight: 400\">Shelby has ordered the <\/span><a href=\"https:\/\/insidebitcoins.com\/news\/grayscale-bitcoin-trust-discount-shrinking-and-investors-back-new-bitcoin-etf-token-with-2m-as-sellout-nears-and-sec-approval-bets-mount\"><span style=\"font-weight: 400\">SEC<\/span><\/a><span style=\"font-weight: 400\"> to argue why sanctions should not be imposed upon the Commission&rsquo;s lawyers.
